Welcome to Cardboard Fiend. The terms “we,” “us,” and “our” refer to Cardboard Fiend, operated by XERO HOLDINGS LLC.

Cardboard Fiend operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Cardboard Fiend is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state of residence, or that you are the age of majority in your state of residence and have given consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing products or services we offer, you may be asked to provide certain information, such as your email address, billing information, payment information, and shipping information.

You represent and warrant that all information you provide is accurate, current, and complete and that you have all rights necessary to provide such information.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to accurately display and describe the products available through our online store. However, product colors, packaging, appearance, or other characteristics may vary from what appears on your screen due to your device, display settings, manufacturer variations, or product revisions.

Product images may be provided by manufacturers, distributors, or other authorized sources and may be used for illustrative purposes. Packaging, promotional markings, and other product characteristics may vary from the images displayed.

We do not warrant that the appearance or quality of a product will exactly match photographs or other representations displayed through the Services.

Trading card products may contain randomized contents. Cardboard Fiend makes no representation or guarantee regarding pull rates, card selection, card value, rarity, condition of cards within factory-sealed products, or the contents of randomized products.

Product descriptions, prices, and availability are subject to change without notice. We reserve the right to discontinue products and to limit quantities offered to any person, household, account, geographic region, or jurisdiction.

SECTION 3 - ORDERS AND CANCELLATIONS

When you place an order, you are making an offer to purchase. Cardboard Fiend reserves the right to accept, decline, limit, or cancel an order for any lawful reason, including suspected fraud, payment issues, pricing or inventory errors, product availability, quantity limitations, or violations of these Terms.

Payment must be successfully authorized and processed before an order can be accepted.

Please carefully review your order before submitting it.

Orders and preorders may be cancelled prior to fulfillment. Customer-requested cancellations are subject to a 10% cancellation fee. Once an order has been fulfilled, it can no longer be cancelled.

For purposes of these Terms, an order is considered fulfilled once Cardboard Fiend has processed the order for fulfillment and marked it as fulfilled in our order management system.

A cancellation request must be received and processed by Cardboard Fiend before fulfillment. Submission of a cancellation request does not itself guarantee cancellation.

The 10% cancellation fee does not apply when Cardboard Fiend cancels an order because we are unable to fulfill it or when a cancellation or refund results from an error attributable to Cardboard Fiend.

Purchases, cancellations, damaged or incorrect orders, and refunds are otherwise subject to our Return & Refund Policy.

We reserve the right to impose purchase or quantity limits when reasonably necessary, including for limited-release or high-demand products.

SECTION 4 - PREORDERS

Products designated as preorders are products expected to become available at a future date.

Release dates and availability estimates are based on information supplied by manufacturers, distributors, and other third parties and are subject to change without notice. Cardboard Fiend does not guarantee manufacturer or distributor release dates.

Preorders may be cancelled prior to fulfillment and are subject to the 10% cancellation fee described in Section 3.

If Cardboard Fiend is unable to fulfill a preorder, the affected item or portion of the order will be refunded in full and no cancellation fee will apply.

Orders containing both preorder and in-stock merchandise may be fulfilled or shipped separately depending on product availability.

SECTION 5 - PRICES AND BILLING

Prices, discounts, promotions, and product availability are subject to change without notice.

The price charged for a product will generally be the price displayed when the order is placed and will be reflected in your order confirmation. Unless expressly stated otherwise, displayed prices do not include applicable taxes or shipping charges.

Prices available through Cardboard Fiend may differ from prices offered by third-party marketplaces, retailers, or other sales channels.

Trading cards and collectible products can experience significant fluctuations in market value. Changes in the market value of a product after an order has been placed do not entitle the customer to a refund, price adjustment, return, or waiver of an applicable cancellation fee.

You agree to provide current, complete, and accurate purchase, payment, and account information.

You represent that payment information provided by you is accurate and that you are authorized to use the applicable payment method.

SECTION 6 - SHIPPING AND DELIVERY

Shipping and delivery dates provided by Cardboard Fiend are estimates only and are not guaranteed.

Delivery times may be affected by carrier delays, weather, holidays, high-volume periods, manufacturer or distributor delays, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address at checkout. Cardboard Fiend is not responsible for delays or delivery issues resulting from incorrect or incomplete shipping information provided by the customer.

If an order arrives damaged during transit, contains an incorrect item, or experiences another issue attributable to Cardboard Fiend, please contact us in accordance with our Return & Refund Policy.

SECTION 7 - RETURNS AND REFUNDS

All sales are final. Cardboard Fiend does not accept returns or exchanges except as otherwise required by applicable law or expressly provided in our Return & Refund Policy.

Customer-requested cancellations made prior to fulfillment are subject to the 10% cancellation fee described above.

Customers should inspect their orders promptly upon delivery. Claims regarding products damaged during transit, incorrect items, or other issues attributable to Cardboard Fiend should be reported in accordance with the timeframes and procedures described in our Return & Refund Policy.

Our Return & Refund Policy is incorporated into these Terms by reference.

SECTION 8 - INTELLECTUAL PROPERTY

The Services, including but not limited to trademarks, branding, text, graphics, images, videos, audio, designs, layouts, and other content owned by Cardboard Fiend, XERO HOLDINGS LLC, their affiliates, or licensors, are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes.

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit material owned by Cardboard Fiend without prior written authorization, except as permitted by applicable law.

The Cardboard Fiend name, logo, branding, product names, designs, and slogans owned by Cardboard Fiend or XERO HOLDINGS LLC may not be used without prior written permission.

Third-party names, logos, characters, artwork, product names, and trademarks appearing on products or through the Services remain the property of their respective owners.

Nothing contained in these Terms grants you ownership of or a license to any intellectual property except as expressly provided.

SECTION 9 - OPTIONAL TOOLS

We may provide access to tools or functionality offered by third parties that we do not monitor or control.

Such tools are provided “as is” and “as available” without warranties, representations, or endorsements of any kind to the fullest extent permitted by applicable law.

Your use of third-party tools is at your own discretion and may also be subject to the applicable third party's terms and policies.

We may introduce new features, tools, or resources through the Services. Such features will be considered part of the Services and subject to these Terms.

The Services may contain links to websites, services, or materials provided by third parties.

Cardboard Fiend is not responsible for evaluating or guaranteeing the content, accuracy, availability, security, products, services, or practices of third-party websites.

If you access a third-party website or service, you do so subject to that third party's terms and policies.

Questions or complaints regarding products or services provided directly by third parties should be directed to the applicable third party.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

Cardboard Fiend is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Cardboard Fiend.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Cardboard Fiend, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Cardboard Fiend to the extent permitted by applicable law.

SECTION 12 - PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify may collect and process certain personal information relating to your access to and use of the Services in order to provide and improve its services.

SECTION 13 - FEEDBACK AND REVIEWS

You grant Cardboard Fiend a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt Feedback for purposes related to operating, improving, or promoting the Services, subject to applicable law.

You remain responsible for Feedback you submit.

We reserve the right, but are not obligated, to monitor or remove Feedback that we reasonably determine violates these Terms, applicable law, or the rights of another person.

SECTION 14 - ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, information provided through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, inventory, or availability.

We reserve the right to correct errors, inaccuracies, or omissions and to update information when necessary.

We may cancel an affected order when information such as pricing or availability is materially incorrect, including after an order has been submitted.

If Cardboard Fiend cancels an order because of a pricing, inventory, or other error attributable to Cardboard Fiend, amounts paid for the affected item or order will be refunded and the 10% cancellation fee will not apply.

SECTION 15 - PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to:

• Violate applicable laws or regulations;
• Infringe intellectual property or other rights;
• Engage in fraudulent, deceptive, abusive, or malicious conduct;
• Transmit malware or other harmful code;
• Attempt unauthorized access to the Services or related systems;
• Collect personal information about others without authorization;
• Interfere with security or fraud-prevention measures;
• Misrepresent your identity or payment information;
• Engage in payment fraud, chargeback abuse, or other fraudulent activity; or
• Otherwise interfere with the proper operation of the Services.

We reserve the right to restrict, suspend, or terminate access to the Services when we reasonably believe these Terms have been violated.

SECTION 16 - AUTOMATED SYSTEMS AND AGENTS

Automated systems, bots, agents, scraping tools, or similar technologies may not access or interact with the Services in a manner that circumvents technical restrictions, security controls, purchase limits, CAPTCHAs, or other measures intended to protect the Services or customers.

We reserve the right to limit or block automated access when necessary to protect the Services, inventory, customers, or Cardboard Fiend.

Termination does not eliminate obligations incurred before termination.

To the fullest extent permitted by applicable law, the Services and products offered through the Services are provided “as is” and “as available,” except for warranties or rights that cannot legally be excluded.

Cardboard Fiend does not guarantee that the Services will always be uninterrupted, secure, timely, or error-free.

Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be waived or limited.

SECTION 19 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Cardboard Fiend, XERO HOLDINGS LLC, and their affiliates, officers, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or relating to your use of the Services or products purchased through the Services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

To the extent permitted by applicable law, you and Cardboard Fiend consent to the jurisdiction of the applicable state and federal courts located in Illinois for disputes arising from or relating to these Terms or the Services.
